These terms and conditions (hereinafter "Terms") govern access to and use of the Necrologie.ca website (hereinafter "the Site"), operated from Montreal, Quebec, Canada. By accessing the Site, you agree to these Terms without reservation.
2. Description of Services
Necrologie.ca is an online obituary directory covering Quebec and Canada. The Site allows you to:
- Browse published obituaries free of charge
- Submit an obituary for publication free of charge via the submission form
- Leave condolence messages on published obituaries
- Create personalized memorial pages through the Éternea service
- Search for obituaries by name, city or region
3. Obituary Publication
Publishing an obituary on Necrologie.ca is free. Obituaries submitted through the form are reviewed by our team before publication. We reserve the right to refuse or remove any obituary containing manifestly false, defamatory or unlawful information.
The user who submits an obituary warrants that they have the necessary authority to do so and that the information provided is accurate. Necrologie.ca cannot be held responsible for inaccurate information submitted by users.
4. Condolence Messages
Condolence messages published on the Site are subject to moderation. Necrologie.ca reserves the right to remove any message deemed disrespectful, hateful, commercial or contrary to public decency, without prior notice.
By publishing a message, you grant Necrologie.ca a non-exclusive licence to display this content on the Site.
5. Éternea Service
Éternea is a personalized memorial page service. Specific terms for this service, including pricing and retention policies, are communicated during the creation of an Éternea page.
6. Intellectual Property
All Site content (design, text, logos, source code) is protected by intellectual property laws. Any reproduction, even partial, is prohibited without prior written authorization from Necrologie.ca.
Photographs and texts within obituaries remain the property of their respective authors or rightful owners.
7. Liability
Necrologie.ca strives to keep the Site accessible and up to date but does not guarantee uninterrupted or error-free service. Necrologie.ca aggregates obituaries from third-party sources (funeral homes, salons) and cannot guarantee the accuracy of all published information.
Under no circumstances shall Necrologie.ca be held liable for direct or indirect damages resulting from use of the Site.
8. External Links
The Site may contain links to third-party websites (funeral homes, government services). Necrologie.ca has no control over these sites and disclaims any responsibility for their content.
9. Right of Removal
Any person concerned by an obituary published on the Site may request its modification or removal by contacting us at info@necrologie.ca. We will process your request as soon as possible.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of the Province of Quebec and the federal laws of Canada. Any dispute shall be submitted to the competent courts of the judicial district of Montreal.
11. Amendments
Necrologie.ca reserves the right to modify these Terms at any time. Modifications take effect upon publication on the Site. Continued use of the Site after modification constitutes acceptance of the updated Terms.
